The arguments that need to be made are that it is a breach of contract as the agreement doesn't say anything about the house needing to be sold or that actually it needs to be refinanced. I also found a good source for a summary of divorce law and I think a number of those arguments can be made in a motion to the court and or in the lawsuit for breach of contract or for reopening the divorce decision.
