I am a solo practitioner in Family Law. my office is in Minneapolis. I need research done on the issue of spousal maintenance. I represent a client who was married 16 years. She has 2 children with her husband, ages 15 and 8. She is employed in the medical/tech industry as an engineer and he is a part-time musician and gives music lessons. Her gross income is twice what he earns. We have computed that her gross earnings per month are $7,425.00 without a 6% contribution for retirement. He agreed to an income of $3,167.00 gross per month. We had an Employment Evaluation done on the Husband which said he had the ability to work at a full time job earning no less than $35,000.00 per year gross with full benefits. It was recommended that husband complete his Bachelor's Degree, which will take one semester. My client will likely have to pay child support and spousal maintenance. We have been told that a court would likely give him 8 years of spousal maintenance. My client and I would like eliminate this or bring it down to 4 years paying more in the first 2 to 3 years and the least amount in the fourth year. We would also like a Karon Waiver on this duration. I need research that will support my position on duration ant amount to be paid for spousal maintenance.
